Terms of Service

By using PlasmaStream (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service. In these Terms, "we", "us", and "our" refer to PlasmaStream, the operator of the Service; you can reach us at houtenbusiness@gmail.com.
Who can use PlasmaStream
You must be at least 13 years old and old enough to use Twitch under Twitch's own terms. By adding the bot to a channel, you confirm that you control that channel or are authorized to configure it, and that your use follows Twitch's Terms of Service and Community Guidelines.
The Service
PlasmaStream is a chat bot and web dashboard for Twitch. It provides a per-channel virtual currency that viewers earn for watching, chat games, custom commands, leaderboards, a browser-source overlay, and configuration tools. Channels may also accept donations from their viewers, and may run a subathon, which is a countdown that things happening in the channel extend. Features may change, be added, or be removed over time.
Virtual currency and games
The in-channel currency, and any points won or lost in games (including features named "gamble" or "slots"), are a play-only feature. This currency has no real-world monetary value. It cannot be bought, sold, redeemed, withdrawn, cashed out, or transferred, and it is not a form of real-money gambling. It exists purely for entertainment within a channel.
This stays true even on channels that accept donations. Real money never buys in-channel currency and in-channel currency never becomes real money. The two systems do not meet.
Your responsibilities
You are responsible for how you configure and use the Service in your channel, including the content of custom commands and your economy settings, and for making sure that use follows Twitch's rules and applicable law. You are responsible for keeping your own Twitch account secure.
Premium subscription and billing
Premium is an optional paid plan, billed through our payment processor, Stripe, on one of two cadences you choose when you subscribe:
- Monthly, $4.99 per month. Charged every month until you cancel.
- Yearly, $49.99 per year (about $4.17 a month). Charged once a year until you cancel, and paid up front for the whole year.
By subscribing you authorize us, through Stripe, to charge the amount for the plan you chose, at that interval, until you cancel. Subscriptions renew automatically. We may change the price with reasonable advance notice, and any change applies to future billing periods rather than one you have already paid for.
Cancelling Premium
You can cancel anytime from your dashboard. When you cancel, your Premium features stay active until the end of the period you have already paid for, and you are not charged again. On the yearly plan that means Premium continues until the end of that year.
Except where required by law, payments are non-refundable and we do not provide partial refunds for unused time, including the unused remainder of a year. Cancelling Premium does not affect a Wallet balance.
Donations
A channel may let viewers send it money from its page on PlasmaStream. This does not depend on any other feature and is available whenever that channel has donations switched on, whether or not they are streaming at the time.
If you are donating, you are paying PlasmaStream, and PlasmaStream credits the streamer's share to them. We are not acting as the streamer's agent and the streamer is not a party to your payment.
Payments are processed by Stripe. We keep 5% + $0.30 of each donation and the rest is credited to the streamer. You may also be offered the chance to cover the payment processing cost on top; that is optional, and it does not change what the streamer receives.
Donations are not refundable. They are announced to an audience the moment your payment settles, and on a channel running a subathon they also move a clock that people are watching. Reversing that punishes people who had nothing to do with the transaction. If something has gone wrong with a payment, email us before contacting your bank and we will look at it.
The name and any message you attach are shown publicly on the streamer's broadcast and in their dashboard. Do not include anything you would not want an audience to see. We may refuse or remove a name or message, and we may refuse a donation, at our discretion.
A donation is a voluntary payment to a streamer. It is not a donation to a registered charity and is not tax-deductible, it is not an investment, and it does not buy goods, services, or anything with resale value. You are not owed anything in return for it.
Donations and subathons
If a channel is running a subathon and has set a rate for it, a donation also adds time to their countdown, and the amount is shown to you before you pay. This is something the subathon does with a donation rather than a separate kind of payment: the money, the fee, and the refund position are exactly the same either way.
A channel with no subathon running, or with the rate set to zero, still accepts donations normally. No time is added, and nothing else about the donation changes. We do not guarantee that any streamer will keep streaming for any particular length of time, whether or not a clock is involved.
Your Wallet
If viewers donate to your channel, their donations less our fee are credited to a balance we call your Wallet. Some things about it are worth being direct about.
- The Wallet is a record of what we owe you, not an account holding your money. Funds sit with our payment processor together with our own, and your Wallet balance is an unsecured claim against us. It is not a bank account, it is not held in trust or segregated for you, it is not insured by any deposit scheme, and it does not earn interest.
- New earnings are held for 10 days before you can withdraw them, because a card payment can still be reversed in that window. Occasionally a payment takes longer than that to settle and a withdrawal has to wait for it.
- Withdrawals go through Stripe. The first time you withdraw, you complete Stripe's onboarding, which is where your identity and bank details are collected. We never see or store your bank details. Stripe may decline or delay a payout on its own terms, and we cannot override that.
- The smallest withdrawal is $10.00. We do not charge a fee to withdraw; our fee was already taken when the donation was made.
- Reversals come out of your balance. If a donation is refunded or charged back, the amount credited to you is reversed. If you have already withdrawn it, your Wallet may go negative and future earnings go toward that before anything is available again.
If you close your channel or we end your access, we will pay out a positive balance you are entitled to, less anything you owe us, once any hold and dispute periods have passed and you have completed the identity checks required to receive it.
Taxes
Money you earn through PlasmaStream is your income, and reporting and paying tax on it is your responsibility. We do not give tax advice.
Stripe collects your tax information when you set up withdrawals and issues the tax forms it is required to issue, such as a 1099 for eligible earners in the United States. Whether a form is issued depends on thresholds and rules that are set by tax authorities and change from time to time, so treat a form arriving, or not arriving, as neither a statement of what you owe nor permission not to report it. If you are outside the United States, your own country's rules apply and Stripe collects the corresponding information.
Acceptable use
You agree not to misuse the Service. This includes using it to break Twitch's rules or the law, harassing others, attempting to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service, or trying to manipulate or exploit the economy or billing systems.
Availability and "as is"
The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee that it will be uninterrupted or error-free, or that any data, including virtual currency balances, will be preserved. This disclaimer does not extend to money owed to you in your Wallet, which we still owe you whatever happens to the rest of the Service.
Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, or consequential damages, or for loss of data or virtual currency, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
Termination
We may suspend or end your access if you violate these Terms or misuse the Service. You can stop using the Service at any time by removing the bot from your channel and, if you have Premium, cancelling it. Ending your access does not cancel a Wallet balance you are entitled to; see "Your Wallet" for how that is paid out. We may hold a balance while we investigate suspected fraud or a breach of these Terms.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above, and your continued use of the Service means you accept the updated Terms.

PlasmaStream is an independent tool and is not affiliated with, endorsed by, or sponsored by Twitch or Amazon.
Governing law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules.
